</span>《机动车交通事故责任强制保险条例》的立法目的，旨在确保“第三者”在交通事故受到损害时，能够从保险人处获得相应的救济，是为不特定的第三人利益而订立的合同。因此，当对“车上人员”与“第三者”的界定存在争议时，应从交强险的性质出发，从有利于受害人获得充分赔偿的公平理念为依据，依法作出认定。本案中，车辆滑行造成彭某受伤的危险后果并不为彭某所控制，认定其作为“第三者”更符合上述立法目的，使其能够获得基本的经济保障。同时，</span><strong><span
