padding: 0px; border: 0px; flex-shrink: 1 !important; line-height: 1.6;"> </section><section class="_135editor" style="margin: 0px; padding: 0px; border: 0px; flex-shrink: 1 !important;">重庆市规范行政处罚裁量权办法 第一条  为了规范行政处罚裁量行为，保障和监督行政处罚裁量权的正确行使，保护公民、法人或者其他组织的合法权益，根据《中华人民共和国行政处罚法》和有关法律、法规，结合本市实际，制定本办法。 第二条  本市行政区域内行政处罚裁量权的规范和行使，适用本办法。 本办法所称行政处罚裁量权，是指行政处罚实施机关（以下称行政机关）在实施行政处罚时，在法定权限范围内依法决定是否给予行政处罚、给予行政处罚具体种类和幅度的处置权。 第三条  行政机关行使行政处罚裁量权应当遵循公正公开、合法合理、程序正当、过罚相当、处罚与教育相结合、高效便民的原则。 第四条  行政机关行使行政处罚裁量权应当综合衡量违法行为的事实、性质、情节、社会危害程度以及区域经济发展水平等因素，排除不相关因素的干扰。 第五条  行使行政处罚裁量权应当平等对待当事人，对同类违法行为且行使行政处罚裁量权综合衡量因素相同或者相近的当事人，所适用的行政处罚的具体种类和幅度应当基本一致。 第六条  市、区县（自治县）人民政府应当加强对本行政区域内行政机关规范和行使行政处罚裁量权工作的组织领导。 第七条  市、区县（自治县）司法行政部门具体负责指导、协调、监督本行政区域内规范和行使行政处罚裁量权工作。 上级行政机关应当加强对下级行政机关规范和行使行政处罚裁量权工作的指导和监督。 委托实施行政处罚的行政机关应当加强对受委托组织规范和行使行政处罚裁量权工作的指导和监督。 行政机关内部负责行政执法监督的机构具体负责本机关规范和行使行政处罚裁量权工作的指导和监督。 第八条  市级行政机关应当根据法律、法规、规章和本办法的规定，综合考虑裁量因素，合理划分裁量阶次，制定涉及本行业、本领域的行政处罚裁量基准。 国务院有关部门已经制定行政处罚裁量基准的，市级行政机关不再制定本市的行政处罚裁量基准；不能直接适用的，可以结合本市经济社会发展状况，在不超出国务院有关部门划定的裁量阶次或者幅度和法律、法规、规章规定的行政处罚裁量权范围内，制定本市的行政处罚裁量基准。 区县（自治县）行政机关根据需要可以对上级行政机关制定的行政处罚裁量基准适用的标准、条件、种类、幅度、方式、时限予以细化量化，但不得与上级行政机关已经制定的行政处罚裁量基准相抵触。 第九条  法律、法规、规章新设或者调整行政处罚的，市级行政机关应当自法律、法规、规章公布之日起6个月内制定或者修改行政处罚裁量基准。因特殊情况不能在规定期限内制定或者修改的，经行政机关主要负责人批准可以延长制定或者修改期限，但最长不得超过1年。 行政处罚裁量基准制定或者修改前，行政机关应当依照法律、法规、规章和本办法规定的行政处罚裁量规则，实施行政处罚。 行政机关定期组织评估行政处罚实施情况和必要性时，应当同时对行政处罚裁量基准的实施情况开展评估，对不适当的行政处罚裁量基准应当及时修改。 第十条  行政处罚裁量基准的制定、公布、备案等，依照《重庆市行政规范性文件管理办法》的有关规定执行。 第十一条  行政处罚裁量基准应当包括违法行为、法定依据、裁量阶次、适用条件和具体标准等内容。 第十二条  制定行政处罚裁量基准，应当符合下列要求： （一）法律、法规、规章规定可以选择是否给予行政处罚的，应当明确规定是否给予行政处罚的具体裁量标准和适用条件； （二）法律、法规、规章规定可以选择行政处罚种类的，应当明确规定适用不同种类行政处罚的具体裁量标准和适用条件； （三）法律、法规、规章规定可以选择行政处罚幅度的，应当合理划分裁量阶次，明确规定适用不同阶次的具体裁量标准和适用条件； （四）法律、法规、规章规定可以并处行政处罚的，应当明确单处或者并处行政处罚的具体裁量标准和适用条件； （五）依法应当明确的其他事项。 第十三条  当事人有下列情形之一的，应当不予行政处罚： （一）不满14周岁的未成年人有违法行为的； （二）精神病人、智力残疾人在不能辨认或者不能控制自己行为时有违法行为的； （三）违法行为轻微并及时改正，没有造成危害后果的； （四）除法律、行政法规另有规定外，当事人有证据足以证明没有主观过错的； （五）除法律另有规定外，违法行为在2年内未被发现的，或者涉及公民生命健康安全、金融安全且有危害后果的违法行为在5年内未被发现的； （六）依法不予行政处罚的其他情形。 初次违法且危害后果轻微并及时改正的，可以不予行政处罚。 第十四条  当事人有下列情形之一的，应当从轻或者减轻行政处罚： （一）已满14周岁不满18周岁的未成年人有违法行为的； （二）主动消除或者减轻违法行为危害后果的； （三）受他人胁迫或者诱骗实施违法行为的； （四）主动供述行政机关尚未掌握的违法行为的； （五）配合行政机关查处违法行为有立功表现的； （六）在共同违法行为中起次要或者辅助作用，且没有造成严重后果的； （七）主动中止违法行为，且危害后果轻微的； （八）法律、法规、规章规定应当从轻或者减轻行政处罚的其他情形。 当事人有下列情形之一的，可以从轻或者减轻行政处罚： （一）尚未完全丧失辨认或者控制自己行为能力的精神病人、智力残疾人有违法行为的； （二）当事人因残疾或者重大疾病等原因生活确有困难的； （三）涉案财物或者违法所得较少的； （四）法律、法规、规章规定可以从轻或者减轻行政处罚的其他情形。 第十五条  当事人有下列情形之一的，应当依法从重行政处罚： （一）危害国家安全、公共安全的； （二）在共同违法行为中起主要作用或者胁迫、诱骗、教唆他人实施违法行为的； （三）经责令停止、纠正违法行为后，仍继续实施违法行为的； （四）多次实施同一违法行为且已受过行政处罚的； （五）伪造、变造、隐匿或者销毁证据的； （六）妨碍执法人员查处违法行为、暴力抗法的； （七）对举报人、证人、行政执法人员有报复行为的； （八）侵害残疾人、老年人、妇女、儿童等受特殊保护群体利益的； （九）法律、法规、规章规定应当从重处罚的其他情形。 发生重大自然灾害、事故灾难、公共卫生或者社会安全事件等突发事件，为了控制、减轻和消除突发事件引起的社会危害，行政机关对违反突发事件应对措施的行为，应当依法快速、从重处罚。 第十六条  罚款数额的确定遵循下列规则： （一）罚款为一定金额的倍数的，减轻处罚应当低于最低倍数，从轻处罚按最低倍数到最高倍数这一幅度的30%以下确定（包含本数），从重处罚按最低倍数到最高倍数这一幅度的70%以上确定（包含本数），一般处罚按最低倍数到最高倍数这一幅度的30%—70%实施行政处罚（不包含本数）； （二）罚款为一定幅度的数额的，减轻处罚应当低于最低罚款数额，从轻处罚按最低罚款数额到最高罚款数额这一幅度的30%以下确定（包含本数），从重处罚按最低罚款数额到最高罚款数额这一幅度的70%以上确定（包含本数），一般处罚按最低罚款数额到最高罚款数额这一幅度的30%—70%实施行政处罚（不包含本数）； （三）罚款只规定最高数额没有规定最低数额的，减轻处罚按最高罚款数额的10%以下确定（不包含本数），从轻处罚按最高罚款数额的10%—30%确定（包含本数），从重处罚按最高罚款数额的70%以上确定（包含本数），一般处罚按最高罚款数额的30%—70%实施行政处罚（不包含本数）。 第十七条  当事人具有多种裁量情节的，按照下列规则实施行政处罚： （一）具有2个或者2个以上从轻情节且不具有从重情节的，一般按照最低处罚幅度实施行政处罚； （二）具有2个或者2个以上从重情节且不具有从轻或者减轻情节的，一般按照最高处罚幅度实施行政处罚； （三）对既具有从轻或者减轻情节又具有从重情节的，应当综合衡量违法行为的事实、性质、情节、社会危害程度以及区域经济发展水平等因素，实施行政处罚。 第十八条  同一违法行为设定了可以并处行政处罚的，按照下列规则实施行政处罚： （一）对只具有从轻或者减轻情节的，实施单处； （二）对只具有从重情节的，实施并处； （三）对既具有从轻或者减轻情节又具有从重情节的，应当综合衡量违法行为的事实、性质、情节、社会危害程度以及区域经济发展水平等因素，确定单处或者并处。 第十九条  行政机关适用本机关制定的行政处罚裁量基准可能出现明显不当、显失公平，或者行政处罚裁量基准适用的客观情况发生变化的，经本行政机关主要负责人批准或者集体讨论通过后可以调整适用，批准材料或者集体讨论记录应作为执法案卷的一部分归档保存。 行政机关适用上级行政机关制定的行政处罚裁量基准可能出现明显不当、显失公平，或者行政处罚裁量基准适用的客观情况发生变化的，报请该基准制定机关批准后，可以调整适用。 第二十条  行政机关应当在行政处罚决定书中对适用的行政处罚裁量基准情况进行说明，增强说理性。 第二十一条  行政机关应当推进行政处罚裁量规范化、标准化、信息化建设，充分运用人工智能、大数据、云计算等技术手段，将行政处罚裁量基准内容嵌入行政执法信息系统，为行政执法人员提供精准指引，有效规范行政处罚裁量权行使。 第二十二条  行政机关发现行政处罚裁量权行使违法或者不当的，应当依法主动、及时纠正。 第二十三条  司法行政部门和上级行政机关可以通过行政执法情况检查、行政处罚案卷评查、依法行政考核、行政执法评议考核、行政处罚投诉举报处理、发布行政处罚典型案例等方式，对规范和行使行政处罚裁量权的情况进行指导和监督。 第二十四条  行政复议机关办理行政复议案件，应当把行政处罚裁量基准作为审查具体行政行为适当性的依据。行政复议申请人认为行政处罚裁量基准不合法的，可以一并提出审查申请，行政复议机关应当依法予以处理。 对不符合行政处罚裁量基准实施的行政处罚，可以通过行政复议意见书、建议书等方式对行政机关实施指导和监督。 第二十五条  行政机关违反行政处罚裁量权适用有关规定的，由有权机关责令改正或者依法纠正，对直接负责的主管人员和其他直接责任人员进行批评教育；情节严重的，依法给予处分。 第二十六条  国家实行垂直管理的行政机关制定行政处罚裁量基准、行使行政处罚裁量权，参照本办法执行。 第二十七条  本办法公布前已经制定的行政处罚裁量基准与本办法规定不相符的，应当自本办法公布之日起6个月内予以修改；没有制定行政处罚裁量基准的，应当自本办法公布之日起6个月内制定。 第二十八条  本办法自2023年3月1日起施行。《重庆市规范行政处罚裁量权办法》（重庆市人民政府令第238号）同时废止。</section></section></section><section style="margin: 0px 0px -1px;
