normal;">被执行人刘某欠付申请执行人徐某等5人借款本金共计380余万元及相应利息，由于刘某多年来仅向各申请执行人履行了生效法律文书确定的部分还款义务，导致双方当事人矛盾较大。2023年初，申请执行人提供线索称被执行人刘某的供职单位将向其发放超额绩效等费用共计约8万余元，执行人员遂及时采取了冻结扣划措施。另据申请执行人称被执行人刘某已经退休，请求法院对已依职权冻结的其住房公积金10万余元予以扣划。因被执行人刘某称其生病需要及时手术治疗，书面申请法院解除对其住房公积金所采取的冻结措施，且情绪较为激动，多次以哭闹甚至以跳楼相威胁，致使双方当事人矛盾更加突出。</p><p style="white-space: normal;">考虑到被执行人刘某等系列执行案件双方当事人矛盾突出，加之刘某对法院执行存在较强的抗拒情绪，社会风险较大，为贯彻落实公正善意文明执行理念，依法平衡各方当事人利益，执行法官决定以“类听证”的方式主持双方当事人协商处理。协商过程中，执行法官充分听取了各方当事人的意见，被执行人刘某等虽然提出了相应的还款计划承诺履行债务，但由于双方积怨已深，各申请执行人均不再相信被执行人刘某等的承诺，坚决不同意作出任何让步。最后，刘某的丈夫同为被执行人温某某表示，刘某治病需要的钱由他另行设法解决，已冻结扣划的18万余元由法院依法用以履行各申请执行人的债务。</p></section></section></section></section></section><section
