!important;">2005年，周小松准备与女友结婚，由于当时没有达到法定结婚年龄，二人婚事暂时搁置。此时，周小松的哥哥周大松（化名）已满22岁，且兄弟二人长相相似，经与家人商议，周小松便拿了哥哥的身份证“蒙混过关”，在老家婚姻登记部门与女友办理了结婚登记。三年后，周大松打算结婚，便拿着弟弟周小松的身份证，在其女友刘丽（化名）家乡湖南省衡阳市祁东县办理了结婚登记。<br !important;">近年来，周大松夫妻感情破裂，刘丽提出离婚诉求，他们开始饱受“错位”婚姻的困扰：2022年，刘丽对周大松提出离婚诉讼，按照《民诉法》规定，她只能来到被告周大松户籍所在地城口县法院起诉离婚。由于周大松登记结婚时的身份证与本人不符，法院了解情况后，以主体不适格为由驳回了刘丽的诉讼请求。</span></p><p style="outline: 0px;max-width: !important;">在了解事实原委后，该院检察二部检察官卢波及同事前往城口县公安机关调取涉及人员的户籍资料，在县档案馆查阅涉及人员的原始婚姻登记资料，并向县民政局婚姻登记处了解类似情况的处理办法。“依据《民法典》规定，这种错位婚姻不属于可撤销婚姻的法定事由。”县民政局相关人士无奈地说。</span></p><p style="outline: 0px;max-width: !important;">经过仔细审查资料，卢波认为这属于以冒名顶替或弄虚作假的方式办理婚姻登记的情况。城口县检察院决定予以立案监督，助力撤销这两段错位婚姻。经电话商议，卢波与四位当事人约定于春节后迅速启动程序办理此案，并计划通过渝湘两地检察远程协作，让当事人少跑路就把问题解决。</span></p><p style="outline: 0px;max-width: !important;">“在户口本上，我和女儿的关系竟然是叔侄，还是有点荒唐。”2023年1月28日，春节上班第一天，卢波与同事迅速来到周小松所在村委会核实情况，并前往周小松家中询问。周小松夫妻对哥嫂的决定表示支持，他表示自己与妻子育有两位女儿，由于“错位”婚姻，女儿只能在户口本上登记为“侄女”，也给他们的家庭生活带来了诸多不便。</span></p><p style="outline: !important;">2月2日，通过互联网远程视频，渝湘两地检察官交换证据资料，分别向当事人进行询问，理清案件事实，明确当事人急迫的诉求，并讨论解决方案及细节。随后，城口县检察院以远程视频方式举行对撤销周大松等人不实婚姻登记检察建议案的公开听证会，听证员们均认为周大松等人的不实婚姻登记应予撤销。</span></p><p style="outline: 0px;max-width:
