normal;">2015年至2019年间，被告人陈某某、方某甲、方某乙、黄某、冯某等人利用淘宝、京东等电商平台和线下商户消费购物支持花呗、信用卡、京东白条等信用额度的特点，通过注册公司申请企业支付宝账户或借用他人企业支付宝账户生成收款二维码，采用虚假交易方式，发给有资金需求的“客户”使用前述花呗等信用额度扫码支付后，陈某某等人扣除相应手续费，将套现资金通过第三方转至套现“客户”账户。通过上述方式，被告人陈某某非法套现1.065亿余元，被告人方某甲、方某乙等人非法套现7333万余元，被告人黄某、冯某非法套现7434万余元。</p></section></section></section></section><section normal;">重庆市城口县人民法院经审理认为，被告人陈某某、方某甲、方某乙、黄某、冯某等人未经国家有关主管部门批准，非法从事资金支付结算业务，扰乱市场秩序，情节严重，均已构成非法经营罪，综合考虑各被告人犯罪的事实、性质、社会危害程度以及具有的法定或酌定从宽情节，判处有期徒刑六年至二年六个月不等有期徒刑，并处五十万元至十五万元不等罚金。一审判决宣告后，被告人方某乙、黄某不服向重庆市第二中级人民法院提起上诉。重庆市第二中级人民法院审理后裁定驳回上诉，维持原判。</p></section></section></section></section><section normal;">本案是人民法院依法惩治犯罪分子利用电商平台信用消费额度非法套现的典型案例。互联网消费金融作为现代金融的重要组成部分，在促进消费、拉动内需，服务构建以国内大循环为主体、国内国际双循环相互促进的新发展格局方面发挥重要作用。然而犯罪分子为非法牟利，通过虚假交易等形式帮助“客户”从信用额度中套取现金，充当非法套现的“资金掮客”，严重扰乱国家金融管理秩序和市场交易秩序，破坏互联网消费金融的健康发展，同时也易诱发赌博、诈骗等违法犯罪行为，社会危害性大。本案中，人民法院充分发挥刑事审判职能，严惩被告人利用电商平台信用消费额度非法套现犯罪行为，维护国家金融安全，促进互联网消费金融健康发展，护航西部金融中心和国际消费中心城市建设。</p></section></section></section></section><section
