normal;">2019年12月，李某某向田某某借款79000元，双方约定2021年10月还清借款本息。2022年5月，田某某因多次催收无果后将李某某诉至法院，经法院主持调解，双方当事人达成分期履行和解协议。和解协议约定期限届满后，李某某仍未向田某某履行还款义务，田某某遂于2023年2月向法院申请强制执行。<br/></p></section><section normal;">执行立案后，执行人员传唤李某某到庭报告财产并就如何履行还款义务进行说明。李某某到庭后称，这些年来由于离婚、疫情等原因，同时李某某的母亲罹患癌症，导致经济困难，实在没有履行还款义务的能力，请求法院能否考虑其情况特殊、确有困难，暂缓执行。另经网络查控系统查明，李某某名下有房屋位于城口县葛城街道商业街某地，但该房屋存在高额抵押，即使进行司法处置，也无法清偿李某某所欠田某某的欠款，属于无益处置。由于上述原因，该案的执行陷入僵局。</p><p style="white-space: normal;">2023年4月，执行干警接到执行申请人田某某电话，称李某某母亲已经过世，按照习俗，李某某将因办丧事收取礼金，希望法院可以当场执行。执行人员经过研判，认为李某某虽然存在未履行生效法律文书的行为，且其母亲过世收取礼金后可能会具备还款能力，但本案的执行应充分考虑社会效果。李某某因其母亲刚刚过世，本就存在悲伤情绪，如在李某某办理丧事期间前往李某某家中执行，极其容易引发矛盾冲突，存在造成负面舆情风险。</p><p style="white-space: normal;">执行人员向田某某做好解释工作后，又通过电话联系李某某，先向其表达了哀悼之情，然后告知其不履行法院生效法律文书的行为可能构成违法犯罪，督促其积极履行还款义务。李某某十分感谢执行人员柔性执行的执法行为，并向法院承诺，他办完母亲丧事后，将会履行相应还款义务。4月24日，在李某某母亲丧事办理完毕后，遂前往李某某家中，并通知田某某也及时到场处理该案。在执行人员主持下，双方当事人达成分期履行和解协议，一起持续多年的民间借贷纠纷案件就此执结。</p></section><section
