normal;">2021年3月12日，被执行人李某向申请人袁某借款1,000,000元，双方约定按月利率2%计算利息。借款后，李某陆续归还袁某借款本金750,000元。2022年5月18日，经双方结算，李某向袁某出具借条一张，确认李某尚欠袁某借款本息合计400,000元，约定借款期限为2022年5月18日至2022年7月17日；同时，李某以其房屋和车位为前述借款本金及利息提供抵押担保，并办理了抵押登记。借款到期后，李某未能按约还款，后经本院调解，被执行人李某定于2022年9月30日前付清全部借款本息，申请人袁某对被执行人名下房屋及车位享有优先受偿权。因李某未能按照调解书约定履行义务，袁某向本院申请执行。</p></section></section></section></section><section normal;">依法选定拍卖机构后，本院根据相关规定在房屋基准价基础上下浮百分之七十（即770,000元）为一拍起拍价在淘宝网拍卖，并时常告知当事双方及拍卖机构多多宣传，引导意向买家竞买。但该房屋在3071次围观、21人设置提醒的情况下终是流拍。按规定，二拍将在一拍起拍价基础上再次下浮百分之二十（即616,000元）为拍卖保留价进行拍卖，而被执行人购买该房屋毛坯花费70余万元，装修花费40余万元，二拍起拍价远远低于该房屋实际价值。为充分维护被执行人的财产权益且尽可能保证申请人在本案执行程序中获得较高执行兑现，在本院调解下，申请人自愿撤回二拍程序，并给予被执行人30天时间自行处置房屋。<br/></p></section></section><section normal;">在本院及申请人监督下，被执行人李某怠于自行处置房屋，本院多次与其沟通无果，申请人再次书面申请挂网二拍。执行人员考虑到房屋处置的合理性及必要性，在征求合议庭意见后无奈以616,000元价格挂网进行二次拍卖，但仍然告知双方私下协商还款方案，如在二拍开拍前履行全部债务或达成和解协议，经申请人申请可以撤回拍卖程序。<br/></p></section></section><section normal;">二拍挂网后，执行人员仍然多次与当事双方电话沟通，希望当事双方特别是被执行人理性思考，尽可能找到其他方式履行义务，保障该房屋不因司法拍卖造成较大程度贬值。在执行人员悉心沟通和协调下，被执行人在房屋开拍前筹集资金全额偿还了袁某借款本金及利息，本案得以执行完毕，被执行人房屋得以保全，当事双方的财产权益均得到了充分保障。<br/></p></section></section></section></section><section
