wrap;">8月2日下午2时30分，城口法院依法对城口县人民检察院提起公诉的被告人杨某涉嫌犯掩饰隐瞒犯罪所得罪一案进行公开开庭审理。市人大代表、县政法委和辖区相关负责反诈宣传的工作人员等45人受邀旁听案件审理，让庭审现场成为生动的法治宣传课堂。<br/></p><p style="text-wrap: wrap;">公诉机关指控，2021年8月的一天，被告人杨某在缅甸认识了“阿勇”，并从中得知提供银行卡帮助转移违法犯罪所得可以获得提成。杨某将该消息告知朋友李某，让其提供银行卡帮助转账，并约定二人平分提成。杨某将需要转账的相关信息告知李某，李某按要求通过微信、支付宝进行转账。2021年9月28日至2021年10月12日期间，二人利用6张银行卡，转移全国各地共12名被害人被诈骗资金共计15余万元，杨某获利1万元。综上，应当以掩饰隐瞒犯罪所得罪追究其刑事责任。</p></section><section wrap;">庭审中，合议庭准确把握庭审节奏和重点，依法引导控辩双方围绕指控的犯罪事实有序举证、质证、辩论，充分听取了控辩双方的意见，被告人认罪认罚，并表示忏悔。合议庭审理后认为，被告人杨某明知是犯罪所得，仍邀约他人提供银行卡接受并代为转账，情节严重，其行为已构成掩饰、隐瞒犯罪所得罪。根据其犯罪事实、性质、情节及悔罪表现，依法当庭作出判决，判处杨某有期徒刑一年八个月，并处罚金一万元，并对其违法所得依法予以追缴，上缴国库。</p><p
